Continuing to use of the mobile application constitutes approval of these terms and conditions of use, as they may be amended from time to time. We urge everyone to review our privacy policy to learn more about how we use the information provided to us by users of the (Medyaf) app.

Data: It means every statement, regardless of its source or form that is used directly or indirectly when dealing with e-commerce.

Person: It means a person with a natural or legal character.

Trader: It means the person who is registered in the Commercial Registry and practices e-commerce.

Practitioner: It means the person who is not registered in the Commercial Registry and practices e-commerce.

Service Provider: It means the trader or the practitioner.

Consumer: It means the person who deals in e-commerce in order to access the products or services provided by the service provider.

User: It means every person, a trader, practitioner, or consumer.

Contract: It means the agreement concluded electronically between the parties who deal with e-commerce.

The Obligations of the Service Provider

1.      The service provider undertakes that all information provided in the registration and included as part of his account is true, complete and accurate. The service provider undertakes to inform us immediately of any changes to this information by updating the information in his account.

2.      The service provider shall ensure that any services or information available through (Medyaf Service Provider) meet their specific requirements before the approval of the process to take place.

3.      The service provider undertakes not to use or allow any other person to use the services of (Medyaf Service Provider) in the following cases (which are, for example, but not limited to): -

A-     To send or receive any material (not) in violation of laws and public law. (Deleting the negation (not) remain as it is without modifying as there is a link between paragraph (1) and paragraph (3) above);

B-     To send or receive any material grossly, inappropriately, disrespectfully and derogatorily threatening or insulting any person, or to send materials that violate trust, copyright, personal rights, publicity, privacy or any rights of any person;

C-     To send or receive any materials for which the service provider did not obtain all necessary licenses or approvals (from us or from third parties), or that constitute or encourage behavior that is considered a criminal offense, or that give rise to civil liability, or is in violation of the law or violates the rights of any third party in any country in the world;

D-    To send or receive any technically harmful material (including computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data, malicious software or other harmful data);

E-     To intercept or attempt to intercept any communications sent through a communication system;

F-     For any purpose other than the one we designed or intend to use;

G-     For any fraudulent purpose;

H-    To violate what is in line with accepted internet practices for any connected networks;

I-       To attempt or commit any act that would do or impose an unreasonably large burden or inconsistent with the implementation policy;

4.      The service provider also undertakes not to allow any other person to do the following: -

A-     To resell any products or services (Medyaf service provider);

B-     To submit false information, including false names, addresses, contact information, and fraudulent use of credit or debit card numbers;

C-     To attempt to circumvent our security or our network, including accessing data not intended for the user, or logging into a server or account that he is not expressly authorized to access;

D-    To implement any form of network surveillance that will intercept data not intended for the user;

E-     To engage in fraudulent interactions or transactions with us or with a service provider (including the interaction or alleged transactions on behalf of a third party where the service provider does not have any authority to bind that third party or the service provider pretends to be a third party);

F-     To extract or hack data from a mobile application;

G-     To use the services or mobile applications in violation of these terms and conditions of use;

H-    To participate in any illegal activity related to the use of the (Medyaf) mobile application or services;

I-       To engage in any behavior that, in our exclusive and reasonable opinion, restricts or prevents any other customer from properly using or enjoying the mobile application or services;

5.      The service provider shall inspect the premises before and after leasing thereof to ensure that the premises' assets, including equipment, furniture, general cleanliness and others are in good condition. It also acknowledges that (Medyaf Application Administration) is not responsible for the loss or damage of any premises or premises' accessories, whether during the stay of the consumer or after his stay.

6.      The service provider and the consumer acknowledge that (Medyaf) is just an electronic mediator, and its role is limited to this basis, and it has nothing to do or any relationship with any dispute that may arise - God forbid - between the service provider and the consumer.

The scope of the License

Medyaf Service Provider grants a (non-exclusive) license of use for service provider in order to access our services and use them for personal purposes only, not for commercial purposes. According to the "Terms of Use", users are not entitled to transfer, assign, sub-license, or terminate thereof, including but not limited to:

1.      To refrain from providing services, renting, leasing, reselling, redistributing or re-licensing these services to any third party;

2.      To refrain from modifying, cutting, translating, summarizing, or creating a sub-business that separates or performs a reciprocal engineering for the design of a platform (Medyaf service provider) or of specifying or attempting to identify or access the source code or the internal design of the services or any text or multimedia images (pictures or audio / video files) or data or other information that is provided by (Medyaf) or a third-party service provider;

3.      To refrain from deleting, changing or making any modifications to the copyright or other official notices provided in the services;

4.      To refrain from intentionally transferring or distributing services, or allowing services to be loaded for uses other than those specified here;

5.      To undertake not to share the name of the service provider, password, or other details used to access the services of (Medyaf service provider);

6.      Users and service providers may not provide, send, receive or store any illegal materials, as part of the (Medyaf service provider's) shipping policy;

Breach of Service Policy

(Medyaf Service Provider Application Administration) reserves the right to seek to implement any available remedies for any breach of service policy, and this includes the right to block access to (Medyaf service provider's) services.

Intellectual Property Rights

1.      All editorial content, information, photographs, illustrations, artwork and other graphic materials, names, logos and trademarks on the mobile application are protected by copyright laws and other international laws and treaties. They belong to us, and users are not entitled to copy, reproduce, re-transmit, distribute, publish, sell, broadcast or circulate these works, logos, graphics, sounds, or images, whether in whole or in part, without prior consent.

2.      The terms of use stipulated herein do not give the right in any way to use any trademark displayed on the (Medyaf) application to any user or any other party without our written consent. Misuse of any trademarks or any other content displayed on the application is prohibited.

3.      (Medyaf) reserves the right to take all legal measures against any unauthorized use of the trademark, our name or our symbols to preserve its rights and tin to protect thereof. All rights not expressly granted herein are reserved. Other product and company names mentioned herein may be the trademarks of their respective owners.

4.      The service provider undertakes and pledges to upload internal and external images or data of the premises subject of the advertisement, and this is limited to the premises subject of the upload only, taking into account that it is free from any advertisement or trademark or any data, for example: (telephone numbers of commercial or non-commercial entities, logos or labels for any commercial products, personal phrases, or any phrases that are in violation or contrary to law and public taste) or in violation of any of the laws and regulations in force in the Kingdom of Saudi Arabia. In the event that his violation of this Clause results in any lawsuits, whether by claiming compensation or claims of copyright infringement, the service provider declares to bear all prescribed expenses and material and moral damages that have been caused or that will be incurred by (Medyaf) and also compensation for any actual or potential lost benefit for (Medyaf).

5.      The service provider undertakes (deleting the phrasal verb "pledges to" and sufficing with the verb "undertakes" to void repetition) upload internal and external images or data of the premises subject of the advertisement, and this is limited to the premises subject of the upload only, taking into account that it is free from any advertisement or trademark or any data, for example: (telephone numbers of commercial or non-commercial entities, logos or labels for any commercial products, personal phrases, or any phrases that are in violation or contrary to law and public taste) or in violation of any of the laws and regulations in force in the Kingdom of Saudi Arabia. In the event that his violation of this Clause results in any lawsuits, whether by claiming compensation or claims of copyright infringement, the service provider declares to bear all prescribed expenses and material and moral damages that have been caused or that will be incurred by (Medyaf) and also compensation for any actual or potential lost benefit for (Medyaf).

Payment

1.      (Medyaf service provider) reserves the right to impose new fees for using the platform or the service or both, if (Medyaf service provider) decides so. In the event of imposing new fees, (Medyaf service provider) will notify the service provider of this, and the option will be available either to continue the "use agreement" or terminate thereof.

2.      The service provider shall pay the value of the services (site and application commission) in the amount of 13% of the total rental value, through a bank transfer to the (Medyaf) account for cash or electronic payments received from the service provider in the event of payment outside the Medyaf app or (Medyaf service provider). The service provider bears exclusively the legal liability for failure to pay for services and purchases as soon as they are received.

3.      (Medyaf service provider) has the right to block the service provider in the event of non-payment of the value due for the service provided, noting that (Medyaf) will not remove the ban on the service provider until the due service fee is paid.

4.      The dues of the service provider will be transferred after processing electronic payments within a period of 3 to 14 working days.

Cancellation of Reservation

1.      (Medyaf) does not bear responsibility in the event of canceling the reservation in the event that the payment is at the service provider’s headquarters (payment upon arrival to the site), whether by the service provider (replacing the phrase "service provider" with "consumer" because the service provider means the one who provides service and not the user or the lessee) or by the service supplier.

2.      In the case of full payment through the application, and then the reservation is canceled more than 72 hours before the date of the reservation, the cancellation is free and the trader (Medyaf Application Administration) will refund the amount to the consumer (the lessee) with deducting the transfer fee, which is equal to a maximum of 3%.

3.      In the case of full payment through electronic payment via (Medyaf) and the reservation is canceled less than 72 hours before the reservation date, (25%) of the reservation value will be deducted as remedying compensation for the service provider and the rest of the amount will be refunded to the consumer with deducting the transfer fee, which is equal to a maximum of 3%.

Compensation

The service provider agrees to indemnify us against any claim, action or lawsuit filed or threatening to be filed against us due to or arising from (a) the use of the services account, (b) any other party using the services account under the service provider's user ID, and / or the personal verification number and / or any identifier number assigned by the company, and / or (c) the service provider's breach of any of these terms and conditions of use. This is in addition to the payment of damages, costs and interest in connection with such a lawsuit or claim.

Legal Responsibility

1.      The information, recommendations and services or any of them provided to you on or through the website, service and platform are for general information purposes only and do not represent any advice. (Medyaf) will maintain, as much as possible, the validity and updating of the website, platform and its contents from time to time. Without prejudice to (Medyaf's) legal responsibility, it does not guarantee that the (contents) of the website or application are free from errors, defects, malware and viruses, nor does it guarantee the correctness, accuracy and updating of the website and the platform.

2.      (Medyaf) does not bear any responsibility for any damages resulting from using (or being unable to use) or downloading (Medyaf service provider application), including damages caused by malicious software or viruses. Also, (Medyaf) is not responsible for the incorrectness or incompleteness of the information, the website or the platform, unless this damage results from intentional misconduct or gross negligence on the part of (Medyaf).

3.      The entire responsibility for the quality of the requested services using the platform or the service rests with the service provider that ultimately provides you with the service. (Medyaf) does not assume, under any circumstances, any responsibility related to or arising from the services provided by the service provider. It also does not assume responsibility for any acts, behavior, conduct, negligence, or all of the above, on the part of the service provider. Therefore, any complaints about the services should be submitted against the service provider.

Responsibility Limits

1.      The mobile applications, services and information related to the application and the use of all related facilities are provided on the principle "as available", without any explicit or implied guarantees.

2.      To the maximum extent permitted by applicable law, we assign all representations and guarantees relating to the mobile application and its contents, including with respect to any inaccuracies or omissions in the mobile application, or guarantees of marketability, quality, or fitness for a particular purpose, accuracy, availability, non-infringement, or implied guarantees of commercial dealing or use.

3.      We do not guarantee that the (Medyaf application) will always be available, uninterrupted, timely, secure, error-free, or free from computer viruses or other harmful code. We also do not guarantee that the (Medyaf) application will not be affected by any natural acts or any other force majeure acts, including inability to obtain or lack of power, wired and wireless communications, or any technical failure of information.

4.      Although we make efforts to include accurate and up-to-date information about the mobile application, we make no guarantees or representations as to its accuracy, timeliness, or completeness.

5.      We shall not be responsible for any acts or negligence of any third party, whatever their cause, and for any direct, indirect, incidental, special, consequential or punitive damages, whatever their cause, arising out of or in connection with the (Medyaf) application and the services provided in the mobile application, the service provider’s access to, use, or inability to use the mobile application or the services provided in the (Medyaf) application, reliance on or downloading the mobile application and / or services, or any delay or inaccuracy in the information or in transferring thereof, including but not limited to damages resulting from loss of business, profits, use, data or other intangible things, even if we have been informed of the possibility of such damages.

6.      We shall not be responsible - in the contract or in tort (including negligence or breach of legal duty) or in any way and whatever the reasons for that - for any indirect, consequential, implicit, special or incidental loss or damage suffered by the service provider or incurred in connection with the mobile application and these terms and conditions of use. For the purposes of these terms and conditions, indirect or consequential loss or damage includes, but is not limited to, loss of revenue, profits, anticipated savings, business, loss of data or goodwill, loss of use or value of any device including software, claims by third parties and all associated costs and expenses and expenses.

7.      In spite of our efforts to ensure that our system is secure, the service provider acknowledges that all electronic data transfers may be subject to interception by others. We cannot, and do not guarantee, that data transfers according to the mobile application, or e-mail transmitted to and from us, will not be monitored or read by others.

Safety

The service provider acknowledges that he is solely responsible for the privacy of the services, and you are solely responsible for their use by anyone else using your account and / or username or password, or your access credentials. Dealing with Others

2.      During your use of the website, platform and service, you may correspond with or purchase goods or services or participate in promotional offers provided by service providers, advertisers or sponsors offering their goods or services via a link on the website or through the platform or service. These links take you outside of the website, platform, and service, which are outside the control of (Medyaf). The websites that you may link thereto have independent terms and conditions as well as an independent privacy policy. (Medyaf) does not bear any responsibility for the content and activities of these websites, and (Medyaf) cannot be held accountable for them. Therefore, you bear all the risks that result from visiting or accessing these sites.

3.      Please note that those other sites may send their own cookies to the service provider, collect their data, or request personal information. Hence, we recommend that you check the terms of use or privacy policies on those sites before using them.

Agreement Term and Termination

1.      The agreement concluded BY AND BETWEEN you and (Medyaf) is for an indefinite period, and you have the right to terminate the contract at any time by permanently deleting the platform installed on your smartphone, thus disrupting your use of the platform and the service provided thereby, and you can close your service provider’s account at any time.

2.      (Medyaf) has the right to terminate (Terms of Use) with immediate effect at any time (by disrupting your use of the platform and the service), in case you do any of the following: (A) Violate or breach any of the user conditions. (B) If (Medyaf) believes that you are misusing the platform or service, and (Medyaf) may not send a previous notice of termination of the agreement.

Invalidity of one or more conditions

The invalidity of any of these “user conditions” does not affect the integrity of the remaining other conditions contained therein valid. In the event of any null or corrupt condition, it is replaced by the two parties with a provision that is acceptable in observance of all circumstances and complies with the provisions of the null condition as much as possible, taking into account the content and purpose of the "current user conditions".

Amendment of the Service and User Terms

(Medyaf service provider) has the right to make periodic changes to the contents of the mobile application, including descriptions and prices of advertised goods and services, at any time without notice. (Medyaf) shall not be responsible for any errors or omissions in the content of the mobile application. We reserve the right to amend these terms and conditions of use from time to time without notice. The revised terms and conditions of use will be posted on the mobile application and will take effect on the date of publication. The service provider is advised to review these terms and conditions frequently.

Applicable Law and Dispute Resolution

The "user's terms" are subject to and apply to the settlement of any dispute, claim or disagreement that arises out of, or related to, the present user terms or any violation, termination, implementation, interpretation or validity thereof or use of the site, service or platform, provided that the dispute is referred to arbitration in the city of Jeddah in accordance with the Saudi Arbitration Law promulgated by Royal Decree No. (M / 34) dated 24/05/1433 AH and the Executive Regulations issued by the Council of the Ministry Resolution No. (541) dated 26/08/1438 AH.

B-     To send or receive any material grossly, inappropriately, disrespectfully and derogatorily threatening or insulting any person, or to send materials that violate trust, copyright, personal rights, publicity, privacy or any rights of any person;

C-     To send or receive any materials for which the user did not obtain all necessary licenses or approvals (from us or from third parties), or that constitute or encourage behavior that is considered a criminal offense, or that give rise to civil liability, or is in violation of the law or violates the rights of any third party in any country in the world;

D-    To send or receive any technically harmful material (including computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data, malicious software or other harmful data);

I-       To engage in any behavior that, in our exclusive and reasonable opinion, restricts or prevents any other customer from properly using or enjoying the mobile application or services;

11.  The user acknowledges that the service provider is not responsible for the loss of any holdings (cash in kind, precious jewels or any other kind owned by the user), and undertakes to ensure that they are well-kept during and at the end of the stay period and the premises is delivered to the service provider.

12.  The service provider shall inspect the premises before and after leasing thereof to ensure the premises' assets, including devices, furniture, general cleanliness and others are in good condition.

13.  The service provider and the consumer acknowledge that (Medyaf) is just an electronic mediator, and its role is limited to this basis, and it has nothing to do or any relationship with any dispute that may arise - God forbid - between the service provider and the consumer (Medyaf).

Payment

5.      (Medyaf) reserves the right to impose new fees for using the platform or the service or both, if (Medyaf) decides so. In the event of imposing new fees, (Medyaf) will notify the users of this, and the option will be available either to continue the "use agreement" or terminate thereof.

6.      You shall pay the value of the services to the service provider in cash or by credit cards as soon as the service is provided to you, and the user bears the exclusive legal responsibility for failing to pay the value of services and purchases as soon as they are received.

7.      (Medyaf) has the right to block the customer in the event of non-payment of the value due for the service provided, or in the event that purchases are not received by the service provider, noting that (Medyaf) will not remove the block on the customer until the payment of the due service fees.

8.      Amounts due to the consumer will be refunded upon cancellation (if any) and usually take place within 3-10 working days, with the transfer fee deducted, with a maximum of 3% of the full paid amount.

9.      In the event that the user is absent from the reservation date for any circumstance, the full amount will be deducted in the case of electronic payment.

Cancellation of Reservation

4.      (Medyaf) does not bear responsibility in the event of canceling the reservation in the event that the payment is at the service provider’s headquarters whether by the user or the service provider.

5.      In the case of full payment through the application, and then the reservation is canceled more than 72 hours before the date of the reservation, the cancellation is free and the amount that was paid by the user is refunded with deduction of the transfer fee, which is equal to 3%.

6.      In the case of full payment via (Medyaf) and the reservation is canceled less than 72 hours before the reservation date, (25%) of the reservation value will be deducted as remedying compensation for the service provider and the rest of the amount will be refunded to the consumer.

Compensation

The user agrees to indemnify us against any claim, action or lawsuit filed or threatening to be filed against us due to or arising from (a) the use of the services account, (b) any other party using the services account under the user's ID, and / or the personal verification number and / or any identifier number assigned by the company, and / or (c) the user's breach of any of these terms and conditions of use. This is in addition to the payment of damages, costs and interest in connection with such a lawsuit or claim.

Legal Responsibility

5.      (Medyaf) does not bear any responsibility for any damages resulting from using (or being unable to use) or downloading (Medyaf application), including damages caused by malicious software or viruses. Also, (Medyaf) is not responsible for the incorrectness or incompleteness of the information, the website or the platform, unless this damage results from intentional misconduct or gross negligence on the part of (Medyaf).

6.      The entire responsibility for the quality of the requested services using the platform or the service rests with the service provider that ultimately provides you with the service. (Medyaf) does not assume, under any circumstances, any responsibility related to or arising from the services provided by the service provider. It also does not assume responsibility for any acts, behavior, conduct, negligence, or all of the above, on the part of the service provider. 8.      The mobile applications, services and information related to the application and the use of all related facilities are provided on the principle "as available", without any explicit or implied guarantees.

9.      To the maximum extent permitted by applicable law, we assign all representations and guarantees relating to the mobile application and its contents, including with respect to any inaccuracies or omissions in the mobile application, or guarantees of marketability, quality, or fitness for a particular purpose, accuracy, availability, non-infringement, or implied guarantees of commercial dealing or use.

10.  We do not guarantee that the (Medyaf application) will always be available, uninterrupted, timely, secure, error-free, or free from computer viruses or other harmful code. We also do not guarantee that the (Medyaf) application will not be affected by any natural acts or any other force majeure acts, including inability to obtain or lack of power, wired and wireless communications, or any technical failure of information.

11.  Although we make efforts to include accurate and up-to-date information about the mobile application, we make no guarantees or representations as to its accuracy, timeliness, or completeness.

12.  We shall not be responsible for any acts or negligence of any third party, whatever their cause, and for any direct, indirect, incidental, special, consequential or punitive damages, whatever their cause, arising out of or in connection with the (Medyaf) application and the services provided in the mobile application, the user's access to, use, or inability to use the mobile application or the services provided in the (Medyaf) application, reliance on or downloading the mobile application and / or services, or any delay or inaccuracy in the information or in transferring thereof, including but not limited to damages resulting from loss of business, profits, use, data or other intangible things, even if we have been informed of the possibility of such damages.

13.  We shall not be responsible - in the contract or in tort (including negligence or breach of legal duty) or in any way and whatever the reasons for that - for any indirect, consequential, implicit, special or incidental loss or damage suffered by the user or incurred in connection with the mobile application and these terms and conditions of use. For the purposes of these terms and conditions, indirect or consequential loss or damage includes, but is not limited to, loss of revenue, profits, anticipated savings, business, loss of data or goodwill, loss of use or value of any device including software, claims by third parties and all associated costs and expenses and expenses.

14.  In spite of our efforts to ensure that our system is secure, the user acknowledges that all electronic data transfers may be subject to interception by others. Agreement Term and Termination

3.      The agreement concluded BY AND BETWEEN you and (Medyaf) is for an indefinite period, and you have the right to terminate the contract at any time by permanently deleting the platform installed on your smartphone, thus disrupting your use of the platform and the service provided thereby, and you can close your user's account at any time.

4.      (Medyaf) has the right to terminate (Terms of Use) with immediate effect at any time (by disrupting your use of the platform and the service), in case you do any of the following: (A) Violate or breach any of the user conditions. (B) If (Medyaf) believes that you are misusing the platform or service, and (Medyaf) may not send a previous notice of termination of the agreement.

Invalidity of one or more conditions

The invalidity of any of these “user conditions” does not affect the integrity of the remaining other conditions contained therein valid. In the event of any null or corrupt condition, it is replaced by the two parties with a provision that is acceptable in observance of all circumstances and complies with the provisions of the null condition as much as possible, taking into account the content and purpose of the "current user conditions".

Amendment of the Service and User Terms

(Medyaf) has the right to make periodic changes to the contents of the mobile application, including descriptions and prices of advertised goods and services, at any time without notice. Applicable Law and Dispute Resolution
